These Terms of Service (the “Terms”) are a legal agreement between you (“you”, the “Customer” or “User”) and Future Power (“Future Power”, the “Company”, “we”, “us” or “our”), a company established and operating in Lebanon. They govern your access to and use of our website, online catalogue and storefront, and the products, installation and after-sales services we provide. By accessing or using the website, requesting a quotation, or purchasing our products or services, you acknowledge that you have read, understood and agree to be bound by these Terms.
1. Definitions
“Website” means the Future Power website and online storefront. “Products” means solar panels, inverters, batteries, accessories and related equipment offered by us. “Services” means site survey, system design, supply, installation, commissioning, maintenance and repair. “Quotation” means a written offer prepared by us in response to your request. “Order” means a confirmed purchase of Products and/or Services.
2. About us
Future Power is a green-energy company established in Lebanon, supplying and installing solar, storage and related energy systems for residential, commercial and institutional customers, with branches in Tyre, Beirut and Maaraka. You may contact us through our Contact page.
3. Eligibility
To purchase Products or Services you must have the legal capacity to enter into a binding contract under Lebanese law. By transacting with us, you represent that you are at least 18 years of age, or that you are acting on behalf of a legal entity or person you are duly authorised to represent.
4. Use of the website
You agree to use the Website lawfully and not to:
- use it in a way that breaches any applicable Lebanese law or regulation;
- attempt to gain unauthorised access to, interfere with, or disrupt the Website, its servers or security measures (including anti-abuse measures such as reCAPTCHA);
- submit false, misleading or fraudulent information, or another person’s data without authorisation;
- copy, scrape, harvest or republish Website content except as permitted under section 13; or
- introduce any malware or use automated means to place orders or overload the Website.
We may suspend or restrict access to any user who breaches these Terms.
5. Products, information & pricing
We take care to describe our Products accurately, but specifications, images, datasheets and availability are provided for general information and may be updated by manufacturers without notice. Where a price is shown, it is indicative and, unless stated otherwise, exclusive of delivery, installation and any applicable taxes or duties. Some Products are shown as “price on request”; for these, and for complete systems, pricing is confirmed in a Quotation. All prices are subject to change until an Order is confirmed. We reserve the right to correct errors in pricing or description at any time.
6. Quotations & orders
Submitting a request, adding items to your cart, or requesting a quotation constitutes an invitation to us to provide a Quotation, not a binding sale. A binding contract is formed only when we confirm your Order in writing (including by issuing an invoice or a signed Quotation). We may decline or cancel any request (for example where Products are unavailable, where a pricing or description error has occurred, or where we suspect fraud), in which case any amount already paid for that request will be refunded. A Quotation is valid for the period stated on it and is subject to stock availability at the time of confirmation.
7. Payment & installments
Accepted payment methods, currency, deposits and any installment arrangements are set out in your Quotation or invoice. Where installment or deferred-payment plans are offered, they are subject to separate written terms and to our approval. Title to Products passes to you only upon full payment; risk passes on delivery.
8. Delivery
Delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control (see section 18). You are responsible for providing accurate delivery details and a safe, accessible delivery location. Please inspect Products on delivery and report any visible damage or shortage promptly.
9. Installation & services
Where you engage us for Services, we will perform them with reasonable skill and care and in accordance with applicable technical standards. You agree to:
- provide safe and timely access to the site and to accurate information about your premises and electrical loads;
- obtain any permits, authorisations or landlord/utility approvals required for the installation; and
- ensure the site is ready for installation as agreed.
Scope, timeline and price for Services are as set out in the relevant Quotation. Additional works requested outside that scope may be subject to a separate charge.
10. Warranties
Products are covered by the applicable manufacturer’s warranty, whose terms, duration and conditions prevail and are passed through to you. In addition, we warrant our installation workmanship for the period stated in your Quotation. Warranties do not cover damage resulting from misuse, unauthorised modification or repair, accidents, force majeure, or failure to follow operating and maintenance instructions. To the extent permitted by Lebanese law, and without prejudice to your statutory consumer rights, all other warranties, whether express or implied, are excluded.
11. Returns, cancellation & consumer rights
Nothing in these Terms limits your mandatory rights as a consumer under Lebanese Consumer Protection Law No. 659/2005 and other applicable laws. Where a Product is defective or not as described, you are entitled to the remedies provided by law. Returns, exchanges and cancellations for other reasons are handled in accordance with the return conditions stated in your Quotation or invoice; custom-configured systems and installed equipment may not be returnable. 12. Estimation tools
Any calculators or estimation tools on the Website (including the solar system calculator) provide indicative estimates only, based on the inputs you supply and typical assumptions. They are not a system design, an offer, or a guarantee of performance, savings or sizing. A binding system design and price are provided only through a site survey and a Quotation.
13. Intellectual property
The Website and its content, including text, graphics, logos, the “Future Power” name and marks, images and software, are owned by or licensed to Future Power and are protected by Lebanese and international intellectual-property laws. You may view and use the Website for your personal, non-commercial purposes. You may not reproduce, distribute, modify or create derivative works from any part of it without our prior written consent.
14. Third-party links
The Website may link to third-party websites or services (for example manufacturer datasheets, maps or messaging apps). We do not control and are not responsible for their content, availability or practices. Accessing them is at your own risk and subject to their own terms.
15. Disclaimers
The Website is provided on an “as is” and “as available” basis. While we work to keep it accurate and available, we do not warrant that it will be uninterrupted, error-free or free of harmful components, or that information (including prices and availability) is complete or current at all times.
16. Limitation of liability
To the fullest extent permitted by Lebanese law, Future Power shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising out of or in connection with the Website, the Products or the Services. Our total aggregate liability in connection with any Order shall not exceed the amount paid by you for the relevant Product or Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Lebanese law, including liability for death or personal injury caused by our negligence, or for fraud.
17. Indemnification
You agree to indemnify and hold harmless Future Power and its staff against any claims, losses, liabilities and reasonable expenses arising from your breach of these Terms or your unlawful use of the Website, Products or Services.
18. Force majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, power or fuel shortages, currency or import restrictions, failures of telecommunications or utilities, epidemics, or governmental actions.
19. Privacy
Our collection and use of your personal data are described in our Privacy Policy, which forms part of these Terms.
20. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on the Website, identified by the “last updated” date above. Your continued use of the Website or Services after changes take effect constitutes acceptance of the revised Terms.
21. Governing law & jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or formation, are governed by and construed in accordance with the laws of the Lebanese Republic. The parties agree to submit to the exclusive jurisdiction of the competent courts of Beirut, Lebanon, without prejudice to any mandatory rights you may have to bring proceedings before the courts of your place of residence under Lebanese consumer law.
22. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right is not a waiver of it. These Terms, together with your Quotation, invoice and our Privacy Policy, constitute the entire agreement between you and us regarding their subject matter.
